At NUE by ElizaChat Inc, your privacy is our top priority. We are committed to protecting your personal information and being transparent about how we use it. This Privacy Policy explains how we collect, use, share, and protect your data when you use our AI mental fitness app. It also details your rights and our compliance with legal obligations and vendor requirements.
1. Data Ownership and Sharing
- Your Data, Your Control: You retain ownership of the information and content associated with your user account.
- No Sale of Personal Data: We do not sell your personal information or share your personal information with third parties for targeted advertising or marketing purposes.
- Service Providers: We disclose certain information to trusted service providers when necessary to operate and provide NUE. These may include cloud infrastructure providers, artificial intelligence providers, communications providers, analytics and application-performance providers, and other vendors that support the operation of the Services. These providers are authorized to process information only for the purposes for which we engage them and subject to applicable contractual and legal requirements.
- Legal Disclosures: We may also disclose information when required by law, legal process, or applicable reporting obligations.
2. Data Collection and Use
We collect data solely to provide and improve our mental fitness support services. Here’s what you need to know:
What We Collect
- Information you provide, such as your account details and conversations with the app.
- Communication details for designated emergency contacts.
- Device Information.
- We may collect personal information about your device, such as your Internet protocol IP address, user settings, cookie identifiers, other unique identifiers, browser or device information, Internet service provider, and location information, including, as applicable, approximate location derived from IP address and precise geo-location information.
- Usage Information.
- We may collect personal information about your use of the Services, such as the pages that you visit, items that you search for, the types of content you interact with, information about the links you click, the frequency and duration of your activities, and other information about how you use the Services.
How We Use Your Data
- To provide mental fitness support.
- To send emergency notifications to emergency contacts you designate, optional, via text messages using Twilio’s secure services.
- To improve app functionality and user experience.
AI Features and Third-Party AI Providers
- Third-Party AI Use. The Services include features powered by artificial intelligence “AI Features.” Some AI Features are provided using third-party AI service providers, each a “Third-Party AI Provider.”
- Data Sent to Third-Party AI Providers. When you use AI Features, the Services may send certain information to Third-Party AI Providers to generate responses and operate the feature. This may include:
- content you submit, such as text entries, voice transcripts, prompts, and attachments you choose to send,
- contextual signals needed to provide the feature, such as conversation history you choose to include and language settings, and
- limited technical data, such as device/app diagnostics, timestamps, and request metadata.
- Which Providers. Our current Third-Party AI Providers may include OpenAI, Google, and Anthropic, and any additional providers we identify in the Services or in our Privacy Policy.
No Marketing Use
We do not use your data for advertising or marketing purposes.
3. Data Retention and Deletion
We retain personal information only for as long as reasonably necessary to provide the Services, fulfill the purposes described in this Privacy Policy, and meet our legal, security, and operational obligations.
- While Your Account Is Active. We generally retain your account information, conversations, reflections, other content you submit, and related service data for as long as your account remains active so that we can provide the Services to you.
- Account Deletion. You may request deletion of your account at any time through the NUE application or through our account-deletion process on our website. When you delete your account, we permanently delete or de-identify personal information associated with your account from our active systems within 30 days.
- Backups. Information may remain in encrypted backup systems for up to 90 days after deletion. Backup copies are maintained for security and disaster-recovery purposes and are deleted through our normal backup lifecycle.
- Limited Retention Exceptions. We may retain limited information for longer where reasonably necessary to comply with applicable law, respond to legal process, prevent fraud or abuse, protect the security of our users and Services, resolve disputes, or enforce our agreements. Information retained for these purposes will be limited to what is necessary and retained only for as long as the applicable purpose requires.
- Third-Party Service Providers. Certain information may be processed by service providers that help us operate the Services, including AI service providers and communications providers. Their temporary retention of information may be subject to their contractual obligations, security requirements, and applicable law. We require service providers handling personal information on our behalf to protect that information and use it only for authorized purposes.
Information that has already been disclosed to a government authority or other third party pursuant to a legal obligation or mandated reporting requirement cannot necessarily be retrieved or deleted by ElizaChat.
4. Communication and Compliance
- Emergency Text Messaging: We use a third-party vendor to send text messages to your designated emergency contacts in rare emergencies. By using NUE by ElizaChat, you consent to such communication. Emergency contacts must also opt-in to receiving such messages.
- Vendor Compliance: Our vendor of choice for sending text messages is Twilio, which adheres to strict privacy and security guidelines, which you can review here: twilio.com/en-us/legal/messaging-policy.
5. Data Protection
We use a combination of technical, administrative, and physical safeguards to protect your data, including:
- Encryption for data in transit and at rest.
- Secure servers and regular security assessments.
- Limited access to data on a need-to-know basis.
While we take every precaution to protect your data, no system can be 100% secure. We encourage you to use strong passwords and safeguard your account credentials.
6. Updates to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, legal obligations, or technology. If changes are significant, we will notify you directly through the app or via email. The “Effective Date” at the top of this policy will indicate when the changes were made.
7. Your Rights
As a user, you have the following rights:
- Access: Request access to the data we have about you.
- Correction: Request corrections to your personal information.
- Deletion: Delete your account and data at any time, subject to the exceptions described in Section 3.
